FlowSMM AI Terms of Service

Version 1.0 Effective Date 12 September 2026

These Terms of Service govern access to and use of the website https://www.flowsmm.ai/, the FlowSMM AI application, and related features (collectively, the "Service"). They constitute a legally binding agreement between the user and Individual Entrepreneur TURAEV BOBOJON ABDURAKHMONOVICH, registered under the laws of the Republic of Tajikistan, Taxpayer Identification Number 045691384, State Registration Certificate No. 0130230513 dated 1 July 2025, with a registered address at: Premises 1, 7/2 Moyonsho Nazarshoev Street, Shohmansur District, Dushanbe, Republic of Tajikistan (hereinafter referred to as "FlowSMM AI", "we", "us", or "our").

By registering, clicking an acceptance button, paying for a Plan, or using the Service, you confirm that you have read, understood, and agreed to these Terms and the Privacy Policy. If you do not agree to them, you must not use the Service.

1 Definitions

2 Right to Use the Service

The Service is intended for persons who are at least 18 years old and have the legal capacity required to enter into these Terms. If you use the Service on behalf of an organisation or another person, you represent that you have authority to bind that person to these Terms. You must provide accurate registration information and keep it up to date.

We grant you a limited, non-exclusive, non-transferable, and revocable right to use the Service for the duration of your Account and paid Plan, solely in accordance with these Terms.

3 Account Registration and Security

• You are responsible for maintaining the confidentiality of your access credentials and for all activities carried out through your Account, except where such activities result solely from the fault of FlowSMM AI.

• You must not transfer or sell your Account to a third party, create an Account in another person's name, or use false information.

• If you suspect unauthorised access, you must notify us immediately at support@flowsmm.ai and change your access credentials.

• We may implement multi-factor authentication, security checks, session restrictions, and other reasonable safeguards.

4 Service Features

Depending on the Plan, the Service may provide content creation and editing, a publication calendar, scheduling, publishing to connected social networks, analytics, collaboration, automation, and AI Features. The features actually included, applicable limits, and technical requirements are specified on the relevant Plan page or within the Service.

We may improve, modify, or discontinue individual features. If a change materially reduces paid functionality, we will notify the user in advance where reasonably practicable and provide any remedy required by applicable law or the terms of the relevant Plan.

5 Connecting Facebook Instagram and Other Platforms

External platforms are connected through their official authorisation mechanisms. You independently select the assets to be connected and the permissions to be granted. FlowSMM AI acts only within the available functionality, the technical capabilities of the relevant API, and the permissions granted by you and the relevant platform.

You instruct FlowSMM AI to perform selected actions on your behalf, including retrieving authorised data, creating drafts, scheduling content, and publishing content. Content is published only at your direct instruction, according to a schedule set by you, or through another form of automation configured by you in advance.

Use of integrations is also governed by the terms and policies of the relevant platforms, including the Meta Platform Terms and Developer Policies. You must comply with those rules. We do not control any external platform and do not guarantee the continuous availability of its API, features, data, or permissions.

You may revoke access through the settings of FlowSMM AI or the relevant platform. Revoking permissions may cause related features to stop working, cancel scheduled publications, or prevent the retrieval of updated data.

6 User Content and Rights in User Content

All rights in User Content remain with the user or the relevant rights holder. You grant FlowSMM AI a limited, non-exclusive right to store, reproduce, technically transform, analyse, transmit to connected platforms, and otherwise process User Content solely to the extent necessary to provide, secure, and improve the Service and to carry out your instructions.

You represent and warrant that:

• you have all rights, consents, and lawful bases necessary to upload, process, use, and publish User Content;

• User Content and its use do not violate applicable law, third-party rights, copyright and related rights, trade mark rights, image rights, privacy rights, or personal data protection rights;

• you have obtained all necessary permissions from persons whose data, image, voice, or materials are included in User Content;

• User Content complies with the rules of each platform on which it is published.

We are not required to review User Content in advance, but we may restrict its processing or remove it where we reasonably suspect a breach of these Terms, applicable law, third-party rights, or the rules of a connected platform.

7 Artificial Intelligence

AI Features may generate outputs that are inaccurate, incomplete, outdated, similar to third-party materials, or otherwise unsuitable. AI-generated output does not constitute legal, medical, financial, or other professional advice. Before publishing or otherwise using any output, you must independently verify its factual accuracy, lawfulness, originality, permitted use, and fitness for the intended purpose.

Do not enter passwords, payment card details, identity documents, trade secrets, special categories of personal data, or confidential third-party information into AI Features unless you have a proper lawful basis to do so. The processing of data by AI providers is described in the Privacy Policy.

If a user uses AI Features, the prompts entered by the user and the selected content may be transmitted to providers of AI models for the purpose of generating the requested output. We transmit only the data necessary to fulfil the request and apply contractual and technical safeguards. Users should not enter passwords, payment details, identity documents, special categories of personal data, or confidential information relating to third parties into AI input fields unless they have a lawful basis to do so.

8 Prohibited Use

When using the Service, you must not:

• violate applicable law, third-party rights, these Terms, or the rules of Meta, Facebook, Instagram, or any other connected platform;

• distribute spam, malicious code, phishing content, or fraudulent, unlawful, discriminatory, abusive, or misleading materials;

• publish content or process personal data without the necessary rights, consents, and other lawful bases;

• circumvent limits, checks, authorisation mechanisms, security measures, or API restrictions, or create unauthorised automation;

• extract data in bulk, scan or decompile the Service, copy source code, or attempt to obtain unauthorised access;

• impersonate another person, artificially inflate metrics, manipulate engagement, or coordinate inauthentic behaviour;

• resell, lease, or make the Service available to third parties unless expressly permitted by the relevant Plan or a written agreement;

• use the Service in a manner that imposes an excessive load, interferes with its operation, or may harm FlowSMM AI, any platform, or other users.

9 Plans Payment and Taxes

The price, currency, billing period, limits, and available features are stated when a Plan is selected. If an automatically renewing subscription is offered, you authorise recurring charges for each billing period until the subscription is cancelled. The price and billing frequency must be displayed to the user before payment is confirmed.

The website does not use payment gateways, and we do not collect or store payment card details. The user must provide valid payment information and pay for the Service when due. If payment is overdue, we may restrict paid features after giving notice or attempting to collect the payment again.

The price includes applicable taxes. The user is solely responsible for any taxes and mandatory charges imposed on the user by law. We provide payment documents to the extent required by applicable law.

10 Trial Period Cancellation and Refunds

Any trial period offered is based on a specified number of tokens and may be subject to functional limitations. If a payment method is required to begin the trial and an automatic charge will be made after the trial ends, this must be clearly disclosed before confirmation.

The user may cancel future renewals by submitting a request to support@flowsmm.ai. Cancellation takes effect at the end of the period already paid for, unless otherwise required by law or the applicable purchase terms.

Refunds are governed by the laws of the Republic of Tajikistan. This provision does not limit any mandatory consumer rights that cannot be waived under applicable law. Refunds for purchases made through an application store are also governed by the rules of the relevant store.

11 FlowSMM AI Intellectual Property

The Service, software, interface, design, documentation, databases, trade marks, logos, and other FlowSMM AI materials are owned by us or our licensors and are protected by law. These Terms do not transfer any ownership rights in the Service to the user.

You may submit suggestions and feedback. Unless otherwise agreed in writing, we may use them without charge to develop the Service, without any obligation to implement them or publicly identify the author, provided that we do not disclose your confidential information.

12 Privacy and Personal Data

The processing of personal data is governed by the Privacy Policy available at flowsmm.ai/privacy-policy. If a user uploads personal data relating to other persons, the user is responsible for having a lawful basis, informing those persons, and complying with applicable law.

13 Third Party Services

The Service may contain links to and integrations with third-party services. Those services are independent of FlowSMM AI. We are not responsible for their content, terms, decisions, availability, API changes, restrictions, removal of publications, or actions taken in relation to a connected account. The user is responsible for reviewing and accepting the terms of the relevant third party.

14 Availability Maintenance and Beta Features

We seek to maintain stable operation of the Service but do not guarantee uninterrupted availability, freedom from errors, or compatibility with all devices and platforms. Access may be temporarily restricted for maintenance, updates, threat mitigation, compliance with legal requirements, or as a result of actions taken by an external provider.

Features labelled beta, test, preview, or with a similar designation are provided for testing, may be unstable, and may be modified or discontinued without prior notice.

15 Suspension and Termination of Access

We may restrict or suspend access where reasonably necessary to prevent a threat, investigate a suspected breach, protect users or platforms, comply with applicable law, remedy outstanding payments, or prevent harm. Where practicable, we will notify the user and provide a reasonable opportunity to remedy the breach.

The user may stop using the Service and delete the Account in the manner described in the Service and the Privacy Policy. Upon termination of access, the right to use the Service ends. Provisions relating to payments, intellectual property, liability, dispute resolution, and any other provisions that by their nature are intended to survive will remain in effect.

16 Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided "as is" and "as available". We do not warrant any particular number of publications, views, followers, sales, level of reach, revenue, or other business result; approval by an external platform of the application, permissions, or content; the continued availability of external API functionality; or error-free AI-generated output.

Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.

17 Limitation of Liability

To the fullest extent permitted by law, FlowSMM AI will not be liable for indirect loss, loss of profit, loss of data, reputational harm, suspension or restriction of an account by an external platform, unsuccessful publication, changes to an API, or consequences arising from the use of AI-generated output.

The aggregate liability of FlowSMM AI for all claims relating to the Service will not exceed the amount actually paid by the user for the Service during the three months preceding the event giving rise to the claim. This limitation does not apply to liability that may not lawfully be limited, including liability for wilful misconduct where applicable.

18 Indemnification

To the extent permitted by law, where the user acts for business purposes, the user agrees to indemnify FlowSMM AI against documented losses, expenses, and third-party claims arising from unlawful User Content, the absence of necessary rights or consents, a breach of these Terms, or a breach of the rules of a connected platform. We will give prompt notice of any claim and provide a reasonable opportunity to participate in the defence.

19 Force Majeure

Neither party will be liable for a failure to perform caused by circumstances beyond its reasonable control, including failures of communications or cloud infrastructure, acts of public authorities, emergencies, cyberattacks, widespread platform outages, and other events of force majeure, provided that the affected party takes reasonable measures to mitigate the consequences.

20 Changes to These Terms

We may amend these Terms to reflect the development of the Service, changes in law, commercial terms, or the requirements of external platforms. The revised Terms will be published at flowsmm.ai/terms-of-services and will state their effective date. Where required, we will provide advance notice of material changes through the Service or by email. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms, unless applicable law requires separate consent.

21 Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Tajikistan. Before commencing court proceedings, a party must send a written claim to the other party using its contact details. The receiving party will have 30 calendar days from receipt to respond.

If the dispute is not resolved, it will be submitted to a competent court of the Republic of Tajikistan at the place where the operator is established, unless another venue is mandatory under applicable law. Nothing in these Terms limits a consumer's right to bring proceedings in a court having jurisdiction under applicable law.

22 Miscellaneous

• If any provision is held invalid, the remaining provisions will remain in effect, and the invalid provision will be enforced to the fullest extent permitted by law.

• A failure or delay in exercising any right does not constitute a waiver of that right.

• The user may not assign any rights or obligations without our prior written consent. We may assign this agreement to a successor in connection with a reorganisation or a sale of the business or assets, subject to applicable law.

• These Terms, the Privacy Policy, the Plan description, and any special terms expressly accepted by the user constitute the entire agreement between the parties regarding the Service. In the event of a conflict, the special terms prevail to the extent of that conflict.

• Electronic communications, actions performed through the Account, and confirmations made through the interface may be used as evidence of intent to the extent permitted by law.
